I had a credit card with First North American National Bank
I had a credit card with First North American National Bank. FNANB turned it over to FLEET CREDIT Card without notice. I defaulted on that loan, but agreed to pay and did pay $1776.77 to a collection agency. Now MCM (Midland Credit Management) is coming after me for $2118.11. The man Mr. Olk coerced me into agreeing to pay $100\month for a year, then they will decide to pursue anything further. But MCM is collecting for First North American National Bank who turned the account to Fleet whom I paid. MCM claims that I didn't pay the Nike Cortez 1776 within the time frame alotted, but why isn't Fleet trying to collect? I'm going to my bank tomorrow and have the payment stopped. I feel that I paid this loan off in good faith and now I'm being harrassed and threatened for a debt I assumed was done. What should I do? I've already filed a complaint with the Better Business Air Max 90 Australia Bureau and with the Attorney General's office. Anything else I can do?
It sounds like MCM is collecting on the FNANB debt, which means that either MCM is collecting for Fleet or Fleet was just handling the service of the loan, but the loan remained with FNANB. The problem is that multiple people and companies may be trying to collect on the same debt. You can always make complaints, but legally you are still obligated to pay the debt owed.
If they ever bring a lawsuit against you, you will use the defense of unjust enrichment to show the judge that you paid certain amounts which will lower the amount of the debt. I would suggest you secure proof that you made that $1776 payment (bank statements, copy of the check, etc.) and keep that in case your case goes to court. Good luck!
